Wrongful Death
The untimely loss of a spouse or family member is one of the most difficult experiences any person will ever go through during their lifetime. The immediate grief often associated with an untimely death is often replaced with thoughts of how to deal with the financial losses associated with the death.
All claims brought in the State of Florida for wrongful death are governed by the provisions of The Florida Wrongful Death Act which is set forth in Chapter 768 of the Florida Statutes. That act identifies the survivors who are entitled to recover monetary damages resulting from an untimely death, provides limits on the recovery available to those individuals, identifies the person who may bring a lawsuit to recover for those individuals, and provides a two (2) year Statute of Limitations for claims associated with wrongful death.
Determining the appropriate value of a claim for wrongful death, including claims available to the survivors and the estate, is a complicated process. In addition to requiring assessment of the immediate economic losses occasioned by the death, the process also requires evaluation of future economic losses to be sustained by the survivors and the estate.
