That act identifies the survivors who are entitled to recover monetary damages resulting from an untimely death, provides limits on the recovery available to those individuals, identifies the person who may bring a lawsuit to recover for those individuals, and provides a two (2) year Statute of Limitations for claims associated with wrongful death.

Determining the appropriate value of a claim for wrongful death, including claims available to the survivors and the estate, is a complicated process. In addition to requiring assessment of the immediate economic losses occasioned by the death, the process also requires evaluation of future economic losses to be sustained by the survivors and the estate.
