Legal Malpractice

Good lawyers, like good doctors, sometimes make mistakes which cause their clients to lose their case. This frequently occurs when a lawyer does not file a lawsuit within the time prescribed by the Statute of Limitations or when the lawyer otherwise does something to cause the case to be lost or dismissed.

Florida Law allows a client to recover financial losses and damages caused by their lawyer’s negligence. However, the time is limited within which to make a claim against a lawyer for professional malpractice. Chapter 95 of the Florida Statute provides that an action for legal malpractice must be brought within two (2) years of the date on which the client knew, or should have known, that his or her lawyer’s negligence caused an economic loss.

A claim for legal malpractice should be investigated immediately. The investigative process requires complicated analysis of whether or not the prior attorney committed an act of negligence, when that act of negligence was committed and when the client knew or should have known of such negligence, and extent of the economic losses and damages caused by such negligence.
