A divorce is one of the most emotionally difficult things ever experienced by most people. Issues involving child custody, child support, alimony and division of property, debts and assets are only a few of the things to be considered when terminating a marriage.

The Florida Family Law Act, Chapter 61, Florida Statutes, applies to all divorces brought before Florida Courts. More importantly, there are specific rules of procedure which apply to family law cases. Most Florida Courts have family law divisions which handle divorces and other related family law cases.

Not all divorces require an attorney. A simplified divorce may be available to dissolve a short-term marriage between a man and a woman who do not have significant property, debts or minor children. The office of the Clerk of Courts can generally provide information concerning a simplified divorce.

Divorces which involve long-term marriages, significant property, debts or minor children, generally require the assistance of an attorney. Those cases will typically involve complicated issues concerning child custody, child support, alimony and division of property and debts.

The Rules Regulating the Florida Bar do not allow an attorney to handle a divorce case on a contingent fee basis. Attorney’s fees associated with a divorce are based upon a reasonable hourly rate.
